I. General Terms and Conditions

§ 1 Basic Provisions

 

 

  1. The following terms and conditions apply to contracts you conclude with us as the provider (Mamadou Aliou Diallo) via the website www.fluffyfriendsshop.de. Unless otherwise agreed, any inclusion of your own terms and conditions is hereby rejected.

  2. A consumer for the purposes of the following regulations is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or a legally competent partnership who, when concluding a legal transaction, acts in the exercise of their self-employed professional or commercial activity.

 

§ 2 Conclusion of the Contract

 

 

  1. The subject of the contract is the sale of goods.

  2. By listing each product on our website, we provide you with a binding offer to conclude a contract via the online shopping cart system under the conditions specified in the product description.

  3. The contract is concluded through the online shopping cart system as follows:

     

    • The goods intended for purchase are placed in the “shopping cart.”

    • You can access the shopping cart via the corresponding button in the navigation bar and make changes at any time.

    • After clicking the “Checkout” or “Proceed to Order” button (or similar) and entering your personal, payment, and shipping information, the order details will be displayed as a final order summary.

    • If you select an instant payment system (e.g., PayPal, Amazon Pay, Sofort, giropay), you will either be directed to the order summary page of our online shop or to the website of the instant payment provider. On that page, you enter the required data. Finally, the order summary is displayed either on the provider’s website or when you are redirected back to our online shop.

     

  4. Before submitting your order, you may review, change (including via your browser’s “back” function), or cancel the order. By submitting the order via the corresponding button (“Place order with obligation to pay,” “Buy”/“Buy now,” “Order with payment obligation,” “Pay”/“Pay now,” or similar), you make a legally binding declaration of acceptance of the offer, thereby concluding the contract.

  5. Order processing and transmission of all information required in connection with the conclusion of the contract takes place by e-mail, partly automated. You must ensure that the e-mail address provided is correct and that receipt of emails is technically ensured, in particular not blocked by spam filters.

§ 3 Special Provisions for Offered Payment Methods

  1. Payment via PayPal / PayPal Checkout

  2. Payment via Mollie

§ 4 Right of Retention, Reservation of Ownership

  1. You may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.

  2. The goods remain our property until full payment of the purchase price.

§ 5 Warranty

  1. Statutory defect liability applies.

  2. Consumers are asked to check the goods immediately upon delivery for completeness, obvious defects, or transport damage and to notify us and the carrier as soon as possible. Failure to do so does not affect your statutory warranty rights.

  3. Deviations from objective requirements are only considered agreed if you were informed beforehand and expressly agreed separately.

§ 6 Choice of Law

  1. German law applies. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of their habitual residence (principle of favorability).

  2. The provisions of the UN Sales Convention (CISG) are expressly excluded.

  2. The full contract text is not stored by us. Before submitting the order, the contract data can be printed or saved electronically. After receipt of the order, the order data, statutory information for distance contracts, and the general terms and conditions will be sent to you again by e-mail.

4. Essential Characteristics of Goods or Services

The essential characteristics are described in the respective offer.

5. Prices and Payment

  1. All prices shown are total prices including taxes.

  2. Shipping costs are not included and are shown separately.

  3. Payment methods available are displayed in the online shop.

  4. Unless otherwise stated, payment claims are due immediately upon conclusion of the contract.

6. Delivery Terms

  1. Delivery terms, dates, and any limitations are displayed in the online shop.

  2. For consumers, the risk of accidental loss or deterioration passes upon delivery.
